Following the release of the Nixon report, significant insights have been gleaned regarding the Government's stance on several pivotal migration issues. Key developments to note include:
Migration Agents' Conduct and Practices: The Government has signaled its intention to intensify its scrutiny of the conducts and practices of migration agents. It is crucial to distinguish between migration agents and immigration lawyers, as the emphasis on scrutiny will predominantly target the former based on previous investigations.
Temporary Visa Holders in the Sex Industry: There is no proposed change to the existing policy that permits temporary visa holders to work within the sex industry.
Public Stand-Down List: In a bid to enhance transparency and uphold the integrity of the Migration Act, the Government will be introducing a public stand-down list. This list will feature Australian citizens or permanent residents who have committed breaches against the Migration Act.
Replacement of the Administrative Appeals Tribunal (AAT): A procedural change will be the phasing out of the Administrative Appeals Tribunal (AAT). In its stead, a federal administrative review body will be established to handle appeals and review matters previously under the purview of the AAT.
Stakeholders are advised to familiarize themselves with these impending changes and consider their potential implications on migration-related matters. Further detailed regulations and guidelines are anticipated, and as always, it is recommended to seek legal advice on specific cases or situations.
